Could it be she's suing for actual damages (medical costs, lost wages, etc.) and leaving the punitive damages to the court/jury?

You can sue anyone anytime, but actually winning the suit is a whole different issue, also depends on the judge you get.... Keeps the lawyers for Disney putting food on the table.

Actually, that convinces me more that it's about bilking Disney for money. By suing for such a low amount, fighting it would cost Disney a lot more than just paying her off. Even after attorney fees, that's still a decent little chunk of change for anyone. It's enough to buy a new car, for example. If she was really as upset as she claims to be, then she'd sue for a lot more to make the company take notice and change its practices. This low amount says to me that she's trying to force a settlement.

I find the groping claim a bit far-fetched. If there was inappropriate contact, I'm sure it was accidental in trying to collect the child being held out to Donald. Besides, we all get groped far more by the TSA trying to get to WDW than I think we could ever be groped by the characters.

Unfortunately, this is the world we live in now. I've spent some time playing Santa Claus, and the first thing I learned was "Always make sure your hands are in clear sight."

With respect to the poor sap in the duck suit, as pointed out before, he has no immediate recourse, no way of communicating that it was an accident.
