I usually hate when the company is sued but this is one suit I agree with. Disney was at fault.

Umm I don't see this ending good for Disney, and I honestly don't think it should end well for Disney. Disney should admit fault in it since their negligence led to the occurrence of the incident.

I'm no attorney, but I think the Disney Corp cannot admit fault at this time. Otherwise, they would get clobbered in civil suits. Ultimately, I think they will settle with the family, but won't ever admit negligence. If they DID admit that it was their fault, then they would receive tons of lawsuits from people who were either on the Monorail, or suffered emotional damage from hearing about it.

WVParkfan is right - Diz can't admit any fault from a legal perspective. Nowadays, with lawsuits and all, you can't admit its your fault. It's like when you have a car accident, your insurance company always tells you to NEVER admit that it was your fault because of possible litigation that will occur afterwards.

I am starting to agree with WVParkfan. There are a lot of money hungry people out there that are willing to pounce on anything they can put a lawsuit on. I really think this will settle out of court and it would seem like the most appropriate and professional thing to do. Procedures changed following this and Disney WAS fined by OSHA for some violations that occurred during the procedure.

Of course that was an exaggeration... but not really too far off base. It's seems like Disney doesn't have a leg to stand on. I also think Disney will settle out of court as per normal and make it so nothing can be disclosed!

If they are going to settle, then why request a trial by jury? Usually if a settlement is in the works they go to a mediator or just negotiate between attorneys. Why go through the expense and hassle of jury selection and discovery? It sounds to me more like Disney has an ace up its sleeve and will use some legal loophole to get them out of this.

Cannot imagine Disney letting this go to a jury...it would be dreadful publicity, repeated in the news regularly, and nothing is ever going to make the family truly whole again. Isn't the rule of thumb on accidents in the hospitality industry, "change something" but don't admit negligence...and as horrible and heartbreaking as this accident was, safetly procedures were over-looked.
