There was a woman on last week talking about how the media and politicans have maniputed people into assuming that people who file these lawsuits are faking it.
Like the McDonald's coffee case, the woman originally asked for them to pay the gap between her insurance and the total cost of immediate and anticipated medical expenses tied to the spill, which was 20k. They offered $800, so she decided to take them to trial since she couldn't cover the costs. The jury then awarded her the millions based upon 2 days worth of coffee sales for the company. The judge knocked the total down, and they agreed on a lower figure.
Then, this is where our legal system gets kind of d*ckish, the corporation is free to talk about it all they want and say how reform is needed and the victim is forbidden from ever speaking of the issue again.
So... when people jump up and down screaming about lawsuits like this, remember the total paid out is may be less than they take in on popcorn purchases at Disney World on a given day and that you're going to the defense of a company that has more rights than you do.

Very likely true Wizzard, but the sad fact is that people in this country have become very litigious, and don't seem to accept any responsibility for their own actions anymore
When we fell off our bikes when we were little, we didn't sue the bicycle manufacturer, the helmet manufacturer (ok, we didn't wear helmets back then), the street department and the brand of tennis shoes we happened to be wearing at the time that the shoelaces came undone and wrapped around the spokes For that matter, we didn't blame our parents when we stubbed our toe really bad because we rode barefoot (or with flip flops) after we were told to put on shoes. We came in, dried off our tears, put a band-aid on our toe and went back outside to play.
Some people just barge ahead in life and if they do stupid things, expect others to pay for those lapses in judgement.

I don't blame people for suing, I do blame corporations and lawyers for getting us to a point where you have to sue. Does anybody realize that company's will do a cost analysis to find out if fixing an un-safe situation is cost effective. That's right a company will rather let someone get injured and then have them (or their survivors) sue then fix it in the first place, because it's cheaper to get sued. So when you hear a politician or company on a soap box talking about how we should rain in law suits, it's not the law suits, it the all about saving a company money!! Don't blame someone for getting hurt, look deeper and see why they were put into that situation in the first place!!

Yeah, imagine if you lived in some toxic area like on a former gas station, electronics factory, or in New Jersey, and, through the chronic exposure, got sick. It would be reasonable to demand payment from the company responsible for the exposure and all.
The lawsuits are kind of a needed mechanisim since we endow all the powers of being a person to a corporation but none of the responsibilities, and if asked for money with no return, they will probably refuse.

Yes, if a company is negligent, a person should be able to sue. But if a person is just downright negligent themselves ~ there must be a reason companies have to put a "do not fold while is child inside" sticker on the strollers and playpens then no, those people shouldn't expect compensation.
Now with this hot chocolate suit, I can kind of see both sides. You would expect hot chocolate to be hot, but the cast member probably should not have handed the cup directly to the child. Although the same situation could have happened if the CM handed the cup to the parent and the parent handed the cup directly to the child without checking how hot the beverage was...like if the parent was distracted on their cell phone...

Actually, a judge will throw out a suit if it is clear that the individual was fully to blame.
I know we say that "someone must have done something" for a sticker to be added, but it is entirely possible that someone took a look at all the possible risks and said "that should go on there as a warning".

The funny thing is there is a local OWS thing here, unlike all the other ones noted, this one is only a couple of hours on a saturday and no one camps out for it. The targets of the protest are closed and the only people to rage against are the security guards and janitors.
