More than likely it is still in pre-trial discovery, and then there's depositions...it's got to go down the road a lot more before it ever reaches the courts...

I don't see where it says the kid's age in the article, but I agree with Wizzard if this kid's like 8 are parents really still testing their kids food temperatures for them? This sounds legitimate to me depending on how severe the kid was burned but trust me you can be severely burned by hot chocolate as it's extremely hot liquid. Think about boiling water getting thrown on your hand, you'll have severe burns.
It's a cruise ship by the way. Who says the mom was even with the kid when it happened? When I was like 10 I'd have my own time when my parents took me on a cruise and I could order sodas with my room key, what's to say this kid didn't do that with a hot chocolate?
There's really not enough detail to make any kind of informed decision though. If this were an adult I'd probably say beat it (like that McDonald's woman, c'mon) and that the consumer has some responsibility but it is a kid and I don't have enough info to blindly say it's the parents' fault.
On the whole I believe consumers do have a certain level of responsibility, but there is a line, especially with children, where the vendor needs to have some accountability too. If I went to a restaurant and they served me undercooked or mishandled chicken and I became violently ill as a result (I'm talking perhaps more than just simple food poisoning) is that my fault or theirs? You could argue the consumer should be aware the food tastes odd or is pink/undercooked but I don't see a big difference between that and giving someone something that is scalding hot.

Isn't it reasonable to accept that food will be hot. -- otherwise they'll complain it's cold.

I absolutely agree that kids need to be protected and a young enough child might not comprehend a drink is hot enough to cause damage. It is also reasonable to assume the food will be hot. This is quite possibly the dumbest Disney-related lawsuit I've ever heard about. I'm pretty much speechless.
The parents are the ones at fault here if they let their kid have a hot beverage unsupervised, come on. Most kids don't understand to be careful with extremely hot or cold foods.
So what are we going to have to serve these things lukewarm now? Wait people will moan about that too...

Unfortunatel we have become a more sue happy society recently and it puts a lot of people in a ver awkward position.
