Ummm wow. That is very creative of the beer company to come up with that given how Snow White and the Seven Dwarfs was recently in the news for being released on Blu-Ray. Although the ad is inappropriate and it is clearly a representation of Disney's Snow White, I think their response is a bit of an overreaction. It is reminiscent of Disney threatening to sue daycare centers in Florida for characters in their murals. Jamieson Brewery is a small brewpub in Victoria, Australia. It appears that the ads ran in Sydney newspapers, but the beer is sold in only 62 stores with only one being outside Victoria and none in Sydney. It is a bit like using a shotgun to kill a fly.

Is Snow White a trade marked charterer? I always thought because of the origins of the story it was in the public domain.

Is Snow White a trade marked charterer? I always thought because of the origins of the story it was in the public domain.
I think their response is a bit of an overreaction. It is reminiscent of Disney threatening to sue daycare centers in Florida for characters in their murals.
Yes, Snow White is a public domain character, but Disney's version of Snow White is trademarked. Remember the whole hooplah a few years back when the Academy Awards had Rob Lowe dancing with Snow White? The problem was in that case the costume and hair style was an exact match for Disney's, which is illegal to do so without the express permission of Disney. Look at the Shrek films for a good example: they had Snow White as one of their princess, but her attire and looks were completely different from Disney. Which means their version of Snow White is protected too. Look at the court cases that involved Winnie the Pooh if you want to see how messy it can get.
The problem in the advert is that Snow White still looks pretty generic. The bow in the hair can hardly qualify her to be a match for Disney. However, the problem comes with the Seven Dwarfs. In the original story, they were plain seven dwarves. Disney developed the separate looks, names, and personalities that matched their names. The bigger problem is having the seven dwarves match Disney's because there's the greater trademark infringement. The ad seems to be more clearly infringing on Disney's dwarves more than it infringes on Disney's Snow White.
And, as for the law, to not vigorously pursue trademark infringement in one case and not the other can be seen as tacit approval of that use. So, yes, Disney had to pursue those Florida daycares for violating trademarks by using those characters without permission. Trademark or copyrights legally don't give automatic protection per se - you must defend it at all times - they merely give the legal standing in court over the other party in determining who has the right and who is at fault.
